Major Victory -- Extreme Associates Case Dismissed!

I'm pleased to report that last week, a major
battle in the ongoing fight for true freedom of speech was
won.  In October 2003, the Justice Department brought
criminal charges against Rob Black (aka Rob Zicari), Lizzy Borden (aka
Janet Romano) and other executives at Extreme Associates
under federal obscenity laws.  The indictment occured about a year
and a half after Black appeared on an episode of Frontline ("American Porn") covering
the adult industry.  On the PBS documentary, Black practically
challenged the government come after him, much to the chagrin of
other producers.

The case was widely thought to be a test case in (then) Attorney
General John Ashcroft's new "War on Porn."  Ashcroft, a favorite
of the religious right, has been busy over the last few years
assembling new specially trained obscenity teams and promised a
wave of prosecutions to "deter others from producing and
distributing obscene material."  To help fund this war, Congress
appropriated $42 million dollars for anti-porn efforts.  In
addition, 10 FBI agents and 42 new attorneys were hired at the Department of Justice, including 25 new trial attorneys. 

In a nutshell, federal prosecutors alleged that Extreme was guilty of selling obscene material
on the Internet and then shipped it through the U.S. Mail across state
lines to an Postal Inspector posing as a customer.  It sounds
minor, but like most federal crimes, the penalties are overly harsh --
five years in prison for each offense and ten years for each offense
thereafter.  In this case, Black and Borden faced a
maximum of fifty years in prison, a fine of $2.5 million dollars
and a $5 million dollar fine for the company.  Taking no
chances, the Feds brought charges in the District Court Western
District of Pennsylvania, an area known for it's traditionalism and
conservative beliefs.  In fact, it is home to many thousands
of "plain people" including the Amish, the Mennonites, and the Brethren.

The specific Extreme Associates titles named in the complaint were Extreme Teen #24, Cocktails #02, Ass Clowns #03, 1001 Ways to Eat My Jizz and Forced Entry. 
Some of the "obscene" footage government prosecutors hanged
their hat on depicted sex scenes with simulated rape and other
acts of violence.  However, the bulk of sexual content in
these titles was little different than countless others gonzo titles on
the shelf, especially those with a misogamy or degradation slant,
a common and popular theme in porn. 

The Defendants moved the court to dismiss the case on the ground
that the federal obscenity statutes infringe on the constitutional
guarantees of liberty and privacy secured by the due process clause of the 14th Amendment. 
When a statute is deemed unconstitutional, an indictment based on it
must be dismissed.  Extreme's attorneys argued that there is a broad right to sexual privacy,
which includes the right to possess and view such material in the
privacy of one's own home.  The Defendants also argued this right
is not diminished by the fact the material viewed is without literary
or artistic merit or inspires lewd or lascivious thoughts in the mind
of the viewer.  In the past, these type of considerations were
important under the Miller obscenity test. 

Extreme's attorneys argued that these rights stem from the holdings
in two Supreme Court Cases, one of which was decided recently:  Lawrence v. Texas (2003) and Stanley v. Georgia (1969).  In Lawrence, the
Court struck down Texas sodomy laws aimed at homosexuals.  In that
case, Houston police arrested and charged two men for the crime of
"deviate sexual intercourse" in the privacy of their own
apartment.  The police were on the scene to investigate an
reported weapons disturbance.  In striking down the Texas statute,
the Court wrote,

"The present case does not involve minors. It does not involve
persons who might be injured or coerced or who are situated in
relationships where consent might not easily be refused. It does not
involve public conduct or prostitution. It does not involve whether the
government must give formal recognition to any relationship that
homosexual persons seek to enter. The case does involve two adults who,
with full and mutual consent from each other, engaged in sexual
practices common to a homosexual lifestyle. The petitioners are
entitled to respect for their private lives. The State cannot demean
their existence or control their destiny by making their private sexual
conduct a crime. Their right to liberty under the Due Process Clause
gives them the full right to engage in their conduct without
intervention of the government. "It is a promise of the Constitution
that there is a realm of personal liberty which the government may not
enter." Casey, supra, at 847. The Texas statute
furthers no legitimate state interest which can justify its intrusion
into the personal and private life of the individual."

Defendants in the Extreme matter further argued, because the
obscenity laws completely ban the distribution of materials that an
individual has the fundamental right to possess and view in private,
the statutes should be subjected to the strict scrutiny test for
constitutionality.  They argued the obscenity statutes fail strict
scrutiny (and the easier to satisfy rational basis
test)  because after Lawrence, the government can no longer justify legislation with enforcement of a "moral code". 

District Court Judge Gary L. Lancaster agreed.  In a 45 page Memorandum,
the Court ruled that "because the federal obscenity statutes place a
burden on the exercise of the fundmental rights of liberty, privacy and
speech recognized by the Supreme Court in Stanley v. Georgia," it was
appropriate to apply the strict strutiny test.  The Court then
held that the federal obscenity statutes do not survive the strict
scrutiny test as applied to the facts of the Extreme case. 
Lancaster cited Lawrence and stated "the government can no
longer rely on the advancement of moral code, i.e. preventing
consenting adults from entertaining lewd or lascivious thoughts, as a
legitimate, let alone compelling state interest." 

Second, the Court stated the obscenity laws were not narrowly drawn
to advance the government's two asserted interests, protection of
minors and protecting unwitting adults from inadvertent exposure to
obscene materials. 

As a result, the Court found that the federal obscenity statutes
"burden an individual's fundamental right to possess, read,
observe, and think about what he chooses in the privacy of his own
home by completely banning the distribution of obscene materials. 
Judge Lancaster ruled this violated "constitutional
guarantees of personal liberty and privacy of consenting adults who
wish to view defendants' films in private", and dismissed the
indictment.

Mary Beth Buchanan, the U.S. Attorney who prosecuted the case was
reported to have issued a statement that she was "very disappointed"
and that her office continues to believe "the federal obscenity
statutes are valid and constitutional."  She stated her office is
"reviewing their options."  It is noteworthy that Attorney General
designate Alberto Gonzales recently told the Senate he intended
"to make the investigation and prosecution of obscenity one of my
highest criminal enforcement priorities."

Sacramento Firemen - Naughtier Than Ever!
Busted For 3 Ways on the Job!

It's hard to believe, but the naughty Sacramento Firemen just can't seem to stay out of trouble!  One would think after the Porn Star Ball fiasco last summer (see my entries on 07.30.04 and 09.22.04), everyone in the department would be on their best behavior, but that's just not the case. 

Yesterday, the Sacramento Bee reported that four firemen were placed on administrative leave pending an investigation for "on-duty consensual sexual misconduct". as described by Sacramento Fire Chief Julius "Joe" Cherry.  The investigation will focus on three separate incidents at Station 12 (Hollywood Park) involving a male captain, two male firefighters and one female firefighter.  According to the Bee article, three individuals would engage in sex acts, while the forth stood on the lookout. 

Interestingly, the Fire Department's rules and regulations do not expressly prohibit sexual conduct at fire stations, where firefighters work twenty-four hour shifts.  However, the rules do require that department employees, "Be governed by the ordinary and reasonable rules of behavior observed by law-abiding and self-respecting citizens. No member shall commit any act tending to bring discredit upon the Department or its members."

Mayor Heather Fargo stated that she was very disappointed, but noted the department has committed themselves to cleaning up.  She said this incident was "another reason why they need to stay focused."  Fire Chief Cherry stated, "We've broken the code of silence." and stated he expected his investigation would be complete in thirty days.

Of all the adult films that I've viewed over the years, no one film has impacted my life as much as "Talk Dirty To Me."  The actual sex scenes are not what drives this movie (although 2-3 are very arousing), but it's the VERBAL SEDUCTION that really carries this movie.  I would recommend this movie to any MAN or WOMAN ...."  Another fan wrote, "BEST ADULT FILM EVER!  This is the creame-de-la-creame of adult film.  Great photography, story, mood.  And some incredible scenes:  Cris Cassidy getting a facial and best of all, when (icon) John Leslie smacks Sharon Kane's cum soaked ass with his cock."

In the gonzo era, dirty talk remains a popular theme.  One of the most successful modern examples is the Gutter Mouths series released by J.M. Productions.  Each scene begins with a short story to set up a raunchy, hardcore sex romp that lasts about 25 minutes punctuated with plenty of nasty talk from the starlets. 

Below is the box to Gutter Mouths #25, a new release with Baby Doll (cover model), Judy Starr, Chloe Dior and Holly Halston.  You can tell a lot about this series from reading the synopsis on the back.  "Baby Doll comes to us from the great state of Wyoming, where screwing truck drivers for beer money is more than a hobby, it's a way of life. As much as guys might enjoy dirty talking females in the sack, when it comes to the workplace, it's a definite no-no.  A recent article in USA Today asserts that it may be an unfair double standard, but high ranking women can seriously damage their careers by being a "gutter mouth" on the job.

Executive coach Debra Benton, author of Executive Charisma and How to Think Like a CEO, states that women need to especially watch phrases with a sexual undercurrent.  Some examples of phrases that get women into trouble are often cliche and commonplace when spoken by men:  put the project to bed, screwed up, stay abreast, blown away, scare the pants off, lie down and take it, ballsy, kiss up, chewed my ass out, worked by butt off and get it off my chest.  These phrases tend to "steer male minds away from the message and give them somethign to chortle about among themselves."  Benton states it has the same effect as wearing a low cut dress to a business meeting.

A couple of weeks ago, 20/20 aired an interesting show on everyone's favorite topic called, "Sex: Myths, Lies & Straight Talk". 

One of the "popular notions" blasted was the belief that women do not like porn.  20/20 cited a recent Stanford University study that found women in fact do get turned on after watching just a couple of minutes of an adult video.  Evolutionary Anthropologist Helen Fisher, a research professor at Rutgers University, also asserts that women do enjoy sexually explicit material with a context -- i.e. features with a plot like those produced by Vivid or Wicked.

20/20 did not provide many details about the research, so I looked into it myself.  The study was performed by a team of medical doctors and Ph.D. researchers at Stanford's School of Medicine.   Twenty test subjects viewed a twenty-three minute "sequence of randomly ordered relaxation and erotic tapes both with and without [sound]."  The women were between the age of 20-30 and of a variety of races.  "The physiologic parameters of vaginal blood flow, galvanic skin resistance, respiration, pulse, and blood pressure, as well as self-reported level of arousal, were simultaneously recorded and correlated with video segments."  In other words, the researchers were looking for physically objective and subjective evidence that the women were "turned on." 

The study concluded that watching the videos for two or more minutes was correlated with increased vaginal blood flow, increased respiration and pulse.  Interestingly, audio did not increase subjective arousal, which may not be a surprise to many porn viewers who have long suffered through countless scenes filled with fake moaning and/or cheesy music soundtracks.  The research was funded by Pfizer, Inc. (makers of Viagra) and the National Institutes of Health National Center for Research Resources. 

The research, titled "Female Sexual Arousal: A Behavioral Analysis" was published December 2003 in the well respected, serious medical journal, Fertility and Sterility (Volume 80, Issue 6).  An abstract of the study can be found here.  If you want to read the full text, a PDF version can be purchased for $30.

ABC conducted an online poll after the show aired and asked the following:

Do women like porn?

Yes, it's as big a turn-on for women as it is for men.

No, women find pornography degrading and distasteful.

54.7% said YES

45.3% said NO

Other research also suggests that women enjoy adult material more than previously believed.  According to Nelson/NetRatings, "the industry standard for measuring online audiences", nearly one on three visitors to adult web sites are women.  These findings were the result of a study involving 40,000 panelists at home and work.  In September 2003, Nelson estimated that 9.3 million women in the United States accessed such sites.

Who would have guessed?!

America continues to put her fingerprints on the world in surprising ways.  This week Hooters opened it's very first restaurant in China.  It's located in a mall complex in Shanghai.

American food chains have proven popular in China.  KFC has over 1000 stores and McDonalds has roughly half that.  However, it's a bold step to go from the family friendly "Happy Meals" to a restaurant chain best known for cold beer and chicken wings, served by scantily clad waitresses with big breasts in tight tank tops.  Even in the USA, Hooters has been controversial almost everywhere and the subject of sex discrimination investigations.  Traditionally, China has been very conservative in the realm of sexuality.  Revealing outfits and public displays of affection have long been taboo. 

"Zhang Yanping is not what you would call a big girl, but with her leggy, slender frame shown off by a small white vest bearing the legend Delightfully Tacky But Unrefined, high-cut orange shorts, sneakers and white sox, she is doing her best to be a Hooters Girl."

The director of operations, Cameron Jiang, says the Shanghai Hooters has gone for friendliness rather than any particular physical build, which could be a problem in a country where women tend to be less busty than those in Western countries. "It's different, but Chinese girls have their own beauty," Jiang said."  According to Jiang, eight more Hooters in China are planned if this one is a success.

Hooters exported Julie Paolini, "a statuesque young woman from North Carolina" to train the Chinese Hooters girls cheerleader style routines.  According to Paolini the Chinese employees are "so eager to learn."  For their efforts, the Chinese Hooters girls earn $1.36 an hour.

What do you Xanga people think?  Sign of the times or a serious miscalculation on the part of Hooters management?  I understand they have their sights on India next.

Q:  ... Referring to your porn review -- can you tell me what's so erotic about anal sex? For the female, I mean. The anus isn't intended for sexual intercourse and it's muscles won't contract like a vagina's.

A:  Wow, that's a great question, but a proper answer is rather complicated!  A good starting place to answer your question is the definition of erotic.  According to the American Heritage Dictionary, it means something that concerns or tends to arouse sexual desire.

First, the answer to your question -- insofar as watching porn goes --  might be absolutely nothing!  I think nearly all porn is (and always was) produced with the male audience in mind, so even if a particular act is not erotic for women, there is no hesitation in featuring it.  Gonzo directors don't care because they see their market as horny, perverted and jaded men ("raincoaters").  There is a shrinking market for "features" with a story and dialog.  Features are often sold to cable TV and and hotel networks.  These "couples" films might be more sensitive to female desires.  The movie I reviewed -- Full Anal Access #04 is definately in the first category.

Second, you have to keep in mind that porn is primarily a visual medium.  So long as something looks "hot" or turns people on for some other reason, that is enough -- even if it bears no relationship to reality.  An anus might not be intended for sex, and it may not be enjoyable to the model, but if the image of a large stiff one up some pretty girl's bum turns on the audience, porn producers will show it.  Like any other industry, adult entertainment is demand driven.  Titles that feature some form of anal sex have dominated porn sales charts for the last five or six years.  At one time, anal sex was a novelty in porn, now it is routine and many discs show it in every scene.  Girls in the industry who do not perform anal sex find difficulty getting work -- especially after they have shot their initial flurry of newbie scenes. 

OK, now that we got the fantasy porn aspect out the way ... let's shift gears and talk about practicing anal sex in real life.  The porn discussion above implies that anal sex in not pleasurable, but in reality many females do enjoy it.  A large, academic survey performed in the early 90's reports that 9% of women report having anal sex in the last year.  Although that may seem like a small percentage, in terms of sheer numbers, it represents a lot of females permitting access to their hershey highway -- millions and millions and millions.  The seminal Kinsey studies from 1948 and 1953 found "11% of males reported, in marriage, a frequency of anal sex ranging from a single attempt to often."  It's possible that some of these women do it soley to please their partner.  However, anal sex is pleasurable for many of them. 

Here's some information from Jack Morin, Ph.D., author of Anal Pleasure & Health:  A Guide for Men & Women and The Erotic Mind:  Unlocking the Inner Sources of Passion & Fullfillment.  Dr. Morin is also a board certified sex therapist, and licensed marriage and family counselor. 

Anal stimulation provides many kinds of pleasure

• The highest concentration of nerve endings is around the anal opening itself. A finger can focus on them especially effectively. When an object or penis is inserted beyond the anal opening into the rectum, other pleasures are involved. The outer portion of the rectum, like the vagina, has several nerve endings. The inner portion responds mostly to pressure.
  
• Some people enjoy the feeling of pressure and fullness once they understand that these sensations do not presage an impending bowel movement. Rectal pressure is especially important to enthusiasts of "fisting," a form of anal sex in which several fingers or even the entire hand and forearm are inserted into the rectum and sometimes into the lower colon.
  
• In men, the prostate-which is just beyond the rectal wall, a few inches in, toward the front of the body-can be a source of pleasure when massaged by a finger, an object, or a penis. Also, the lower end of the penis, or "bulb," is near the anal opening. It is stimulated indirectly by most types of anal sex.
  
• Anal pleasure can be psychological as well as physical. The anal taboo adds to the thrill of the forbidden.
